Permanent Total Disability Lawyers
A tragic workplace accident can render an employee unable to work at any job for the rest of his or her life. When such an employee is hurt and unlikely to recover, he or she may be entitled to receive permanent total disability benefits through workers’ compensation. Injuries that would cause one to be permanently and totally disabled from an employment standpoint include:
- Loss of both eyes
- Loss of both arms
- Loss of both legs
A person who has suffered a permanent total disability as a result of an on-the-job injury may be entitled to work disability benefits for life. At Morrison, Webster & Carlton, Attorneys at Law, our permanent total disability lawyers are committed to getting our clients the compensation they deserve to continue to live their lives after a tragic workplace accident. When insurance companies dig in their heels and resist paying benefits you are owed, we can help.
Permanent Total Disability Payments
The rate paid to an employee permanently and totally injured on the job equals 66 2/3 percent of the salary he or she was making at the time of the accident, up to a defined allowable amount, and can be paid either weekly or in a lump sum.
If it’s not a single injury, but the combined result of a previous injury and a new one that causes your total permanent disability, your employer and its insurer may not owe you total permanent disability benefits. Instead, it may owe you permanent partial disability benefits, and you would have to petition the Missouri second injury fund to make up the rest.
Suffering a severe on-the-job accident is traumatic enough without having to fight your employer and insurance companies to recover owed benefits. At Morrison, Webster & Carlton, Attorneys at Law, our permanent total disability attorneys are here to be your tireless advocates. We will do everything we can to get you the resources you need to live your life.
